The City of Mukilteo has received an application for a proposed single-family residence located at 9408 63rd Place West. The applicant has also applied for a reasonable use permit (RUP) with three variance requests for development of the proposed single-family dwelling. The variance requests include:
- Reduce the building setback from a critical slope from 25-feet to 0-feet (Mukilteo Municipal Code (MMC) 17.52A),
- Reduce the building setback from the front property line from 25-feet to 5-feet (MMC 17.20), and
- Increase the maximum allowable building height from 30-feet to 46-feet (MMC 17.20).

What is a Reasonable Use Permit?
A reasonable use permit is a process that allows an applicant the opportunity to demonstrate that the strict application of the City’s critical areas requirements would deny all reasonable use of a property. If this can be demonstrated, then development may be permitted subject to appropriate conditions.
Reasonable use permits in Mukilteo have two different potential types of review:
- Administrative; and,
- Hearing Examiner variance public hearing.
Proposals seeking more than a 50% reduction in required setbacks are processed as a Hearing Examiner variance public hearing. The applicant’s proposal seeks more than a 50% reduction in setback requirements; therefore, a Hearing Examiner public hearing is required.

What is a variance?
A variance is an adjustment made in the application of the specific regulations of this title to a particular piece of property. The property would be unbuildable because of special hardship conditions. A variance may be granted only if a specific set of criteria met.

Who will approve or deny this permit?
Variance applications (non-administrative) are reviewed and decided on by the Hearing Examiner following an open record public hearing. The Hearing Examiner is a third party land use attorney who provides an impartial review of the application. The public hearing is open to the public to make comment for the Hearing Examiner to consider in the decision. A public hearing date for this proposal has not yet been set.
Who will review the slope stability?
The applicant has hired a licensed geotechnical engineering firm to review the proposal’s impact on slope stability. The City will consult with a third party licensed geotechnical engineering firm to review the work of the applicant’s geotechnical firm.
